Privacy is a fundamental human right. We will uphold the privacy of our users by fighting against ads, trackers and other impingements on privacy. We will never profit by monetizing your data but instead seek to fulfill our company mission by delivering a great product & service.

Our commitment to privacy and data protection is reflected in this Privacy Statement which describes how we collect and process "personal information" that identifies you, like your name or email address. Any other information besides this is "non-personal information." If we store personal information with non-personal information, we'll consider that combination to be personal information. Only if we remove all personal information from a set of data would we consider the remainder non-personal information.

Data We Collect

ChartedSails collects the following types of information:

Account Information: Name, email address, and password when you create an account.

Sailing Data: GPS location tracks, speed, course, and sailing session metadata recorded by the app or synced from connected devices (Garmin, Vakaros).

Boat Instrument Data: Data from connected NMEA devices via WiFi, including speed, wind, and other instrument readings.

Photos and Videos: Media you choose to upload to your sessions.

Analytics Data: Information about how you interact with our service, including pages visited, features used, and interaction patterns.

Information Gathering & Use

ChartedSails LLC strives to continually improve our service for our users. To that end, we learn information about you when:

• you directly provide it to us
• we collect it automatically through our products and services
• someone else tells us information about you; or
• when we try and understand more about you based on information you've given to us.

We use your information only as you've permitted and in service of bettering your user experience.

Analytics and Tracking

To help us understand how users interact with our service and to improve our product, we may use third-party analytics services, including:

• Google Tag Manager: Helps us manage and deploy analytics and marketing tags
• PostHog: Provides product analytics to understand feature usage and user behavior
• Meta Pixel (Facebook Pixel): Used on our website only to measure the effectiveness of advertising and understand user actions. Meta Pixel is not used in the mobile app.

These services may collect information such as your IP address, browser type, pages visited, time spent on pages, and interaction data. This information is used solely to improve our service and user experience. You can opt out of these analytics services through your browser settings or by using privacy tools.

ChartedSails Mobile App

The ChartedSails mobile app collects additional types of data to provide its core functionality:

Location Data: The app records GPS location to track your sailing sessions. Location data is only collected while you are actively recording a session.

Health Data: The app can collect heart rate data from connected Bluetooth heart rate monitors. This data is stored alongside your sailing sessions to help you analyze your physical performance. Health data is used solely to display your heart rate during sailing sessions and is never used for marketing, advertising, or shared with third parties for data mining purposes.

Bluetooth Data: The app connects to Bluetooth heart rate monitors with your permission to capture heart rate data.

WiFi Instrument Data: The app can connect to boat instruments via WiFi (NMEA gateways) to capture additional sailing data such as wind speed and direction.

Device Permissions: The mobile app will request permission before accessing location services, Bluetooth, or local network (WiFi). You can manage these permissions at any time in your device settings.

Data Retention

We retain your data for the following periods:

• Account information: Retained while your account is active
• Sailing sessions, health data, and uploaded media: Retained as long as your account exists, or until you delete them
• Analytics data: Retained indefinitely to help us understand long-term usage patterns and improve our service
• Upon account deletion: Personal data is deleted within 30 days, except where retention is required by law

Information Sharing

We share information about you:

• when we've asked & received your consent to share it
• as needed to process or provide services or products to you, but only if those entities agree to provide at least the same level of privacy protection we're committed to under this Privacy Statement
• to comply with laws or to respond to lawful requests and legal process, provided that we'll notify you unless we're legally prohibited from doing so. We'll only release personal information if we believe in good faith that it's legally required.
• only if we reasonably believe it's necessary to prevent harm to the rights, property or safety of you or others; or
• in the event of a corporate restructuring or change in our organizational structure or status to a successor or affiliate.

Information Protection

ChartedSails LLC implements physical, business and technical security measures to safeguard your personal information. In the event of a security breach, we'll notify you so that you can take appropriate protective steps.

Your Rights and Choices

You have the following rights regarding your data:

Delete your account: You may delete your account at any time from your Profile page in the mobile app or on the web at chartedsails.com. Upon account deletion, your personal data will be deleted within 30 days.

Delete your data: You can delete individual sailing sessions, photos, and videos at any time through the app or website.

Export your data: Request a copy of your data by emailing privacy@chartedsails.com.

Revoke consent: You can manage device permissions (location, Bluetooth, local network) at any time in your device settings.

Other Information

As part of our normal operations, your information may be stored in computers in other countries outside of your home country. By giving us information, you consent to this kind of information transfer. Irrespective of where your information resides, we'll comply with applicable law and abide by our commitments herein.

We don't want your personal information if you're under 13. Do not provide it to us. If your child is under 13 and you believe your child has provided us with their personal information, please contact us to have such information removed.

EU, EEA, Swiss and California Users

These regions have data protection laws that require us to specify the following:

Our lawful bases for collecting and processing personal information under the European General Data Protection Regulation ("GDPR") include:

• performing our contract with you and providing our services
• legitimate interests: we receive technical and interaction data of users, which may include IP addresses, to improve the security and reliability of our services and prevent abuse, and to understand where people learn about ChartedSails
• consent: where we ask for your consent to process your information, you can always withdraw this consent.

The following rights are granted under the GDPR and California Consumer Privacy Act ("CCPA"). ChartedSails LLC applies these rights to all users of our products, regardless of your location:

• The right to know what personal data is collected
• The right to know if personal data is being shared, and to whom
• The right to access your personal data
• The right to request deletion of your personal data
• The right to exercise your privacy rights without being discriminated against
